Open Question: What is the process to start a class-action suit against Bank of America?

I've read all the horror stories about Bank of America's creative accounting schemes so I know I am not alone.

I am yet another victim of their overdraft boosting practices and I am fighting back!

I'm not interested in any "blame the accuser" tactics about how well I should balance my checkbook. SO SAVE THEM.

I know there is credibility to my complaint if Congress has introduced an act addressing the exact issues I have with the bank.

H.R. 946: Consumer Overdraft Protection Fair Practices Act.

So how do I get started?
How many of us does it take? There is more than enough I bet.
How can the Sarbanes-Oaxley act help in terms of proving accounting fraud?

I have read of blofa (Banking liars of America) settling a 1 billion overdraft class action; anyone has details?

To any naysayers:

Yes I keep a check register.

Yes the expense of retaining a lawyer is worth my troubles.

Even if I lose, bringing the bank's deceptive practices to light in court is worth it.

Open Question: Hi i need lots of advice on my first car and car loan, only very knowledgeable people respond please.?

First off i am really considering a 1992 Mercedes Benz sel500 as my first car. It is $5,000 and has 106k miles and good condition. Is this a good price? I make $450 every 2 weeks and live at home so i dont really have any expenses. Will i be head over heels with this car? Like repairs and all that? I here they are very expensive to maintain. O.k so i have $2000 to pay upfront but need a $3000 loan, i know banks do not give such small car loans and especially for a 16 year old car!! Also how exactly do i go about obtaing a $3000 loan? I really dont want to ask my parents to co sign as i want to prove my dependancy, pleaqse give me the step by step process for the 3k dollar loan, thanks so much.

Resolved Question: Stafford Loan, Certification in process?

How long does the "certification in process" take? I've checked my loan at Sallie Mae's website, it says that they are waiting on the school to certify the loan. I applied about 6 weeks ago.

I'm getting Pell this year, it will pretty much cover my books and tuition, but I have other expenses, which is why I applied for the loan. I understand I can borrow up to the cost of attendance, roughly $7600. My Pell is about $2600. I should be okay, right?

I've called the financial aid office, and emailed, and I'm having trouble getting a response. Should I worry about how long it's taking to 'certify' the loan?

Open Question: What do you guys think of this introduction, on why I want to be a public service officer? Part two?

for those who answered my first question, I would first like to say thank you so much for taking time out of your busy schedule to help me out. Also, I'd like to say yall are 100% correct. The reason why I say that is because during the interview process, the sheriff informed me that they would be spending a lot of time, money, resources on training me. Even though I let him know I would be transferring to either Georgetown located in Washington, DC or the University of Texas located in Austin, either way I would be leaving Houston/Friendswood eventually. However, I promised them if I were to be hired I would give them two good loyal years. But by the expression on his face, I don't think he was too interested. Now I am currently attending a community college in the Houston area, and have no job. I have had part-time jobs in the past such as Best Buy in which are not bad, but at this point I would really be interested in looking for employment somewhat related to my future ambitions in life. Something I could put down on the resume, ask for letter recommendation maybe down the road, etc. and if I could get paid in the process, to pay for my expenses. That would be a dream come true, for I have volunteered at various places and as much as I really did enjoy them it did not pay me a salary. Any help would be greatly appreciated. I just don't know where to look for these jobs.

Okay Lover, it took me a while to realize you changed your name. I don't think I'm asking this question very clearly. I was told by a mechanic that it was much more expensive to dispose of or recycle used synthetic motor oil than regular used motor oil. I want to know if this is true and why. Resolved Question: divorce and bankruptcy?

I am currently in the process of a divorce. I am now broke. I have no savings left and currently have more then double my annual income in JOINT debt. My soon to be ex wife has no living expenses and an income equal to or greater then mine. As I understand the law now, If I file bankruptcy Ch. 13 I still have to pay the debt that the decree says. and the only way to do it is if we both file seperate bankruptcies. Anyone going through or has gone through this with the new screw you bankrupty laws?

Voting Question: This air force base's incompetent finance office employees..?

We recently moved here over a month ago, put in for our DLA (Dislocation Allowance) the first week we were here, they told us it would take 1-2 weeks to process. 2 1/2 weeks later when my husband went to check the status the paperwork hadn't even been turned in--it'd been sitting in the office the entire time. The manager apologized profusely and told him that employee would be dealt with accordingly. He then re-applied for the DLA and travel expense (for myself and baby driving here) and was told it would be expedited, and would take 3-5 days to process. It's been almost two weeks. Yesterday he went up there in the morning and they told him to come back that afternoon; he did, they called whatever base handles these things, and they said their systems were down. "Come back tomorrow," she told him. Today there is a sign on the door that says "We are closed, please call or email for immediate assistance." How convenient that there is no e-mail address or phone number listed anywhere.
The lady must have known they would be closed all day today, as the sign was there before 7 am, when they open up. What the hell?? They are rude and clearly incompetent; they make us feel like we are a nuisance when all we are doing is trying to get our DLA, which is totally entitled to us. This is our first home and on his E2 pay we cannot afford to purchase furniture and appliances out of his checks. We don't even have a microwave right now--or a couch, let alone any other furniture. The movers lost 1/2 of our daughter's crib, so she has been sleeping on the floor or with us since we got here. Is there anything we can do? Surely these employees must report to someone--I am new to the army, so I have no clue where to go from here. All I know is we are sick of their complete inability to do their jobs. Help!

Voting Question: Tax Question: Should I buy rental property with a mortgage or take out a home equity loan?

I am buying a rental property for $50K. I will put 10K down so I need to borrow $40K

I have 2 offers that will determine whether I will apply the mortgage interest on my schedule E for rental property or as an itemized deduction on my 1040.

Home equity loan against my primary house at 6.09% with $300 loan processing fee. 15 year note - 1st years interest payment will be $2452 - I think this interest would be an itemized deduction.

Mortgage for the investment property at 6.25% with 1 3/8 points. Total fee is $2100 including points. 15 year note - Ist years interest payment will be $2492 I think this would be an expense on my schedule E.

I am at a 28% tax bracket and have no other mortgage on my primary house.

To further complicate the picture I have $34000 in student loan debt and could roll this into my home equity loan.

What would be best for my taxes? Take the home equity loan or a mortgage on the new property? Should I roll my student loans into the home equity loan?

i got accepted into college....but my mom makes 16,000 dollars a year...my college (including expenses) costs like 17,000 a year. as i get closer i realize how stupid i am to actually believe that i could have a better life. i have gotten pretty much my first year covered...but the prob is as u go further in less and less scholarships are offered. i dont know how the loan thing works....no one has ever bothered to teach us how to look for scholarships or how to do loans....im just starting to think that maybe i was stupid to believe that i could go from being poor to slightly middle class....i dont know what to do. if some can explain the student loan process that would be helpful and if someone could help me figure out if its at all possible to have this dream.

If i am starting out with for example with a pin striped fabric which is tailored into a shirt and before the buttons are sewn on,is starched and before it dries is press ironed to reveal its rigid new feel,then waxed to give it the glossy finish you see on expensive designer shirts(but how???).The buttons and the washing instruction tags are sown on after which its press ironed under low heat into folds to consequently get packaged(in the see through plastic wraps) and bundled into dozens awaiting whole sale.
please help,give step by step instructions if possible to avoid the chances of ruined draft trial shirts.

Voting Question: Fiance's sisters refuse to take care of sick mother, call them "good Christian"?

My fiancÃ©'s mother had a stroke. H was nice enough to take her in and he's in the process of getting her a full time nanny.
Her medial expense (not covered by insurance) plus the nanny will be at least $1,800/month. None of my fiancÃ©'s other three siblings
are willing to help in any way though they all agreed to hire the nanny. Both of his sisters are doctors, and they claim they have to pay children's piano lessons, and they are living on budget.
Also, they have to donate $200/week to the church.
My fiancÃ© is an upper middle class at best, and we are saving up to buy a house. I simply don't feel it is fair to let him paying the $1,800/month all by himself.
Now, since I have a flexible work schedule, I have to take care of MIL in the morning and afternoon, and me and my fiancÃ© take turns to help my MIL with toilet and bathroom needs. (I hate that, but I suck it up and do it)
My fiancÃ© talked to his sisters if they can help us paying some medical expenses, the sisters say No, she has to
the sisters say No, she has to pay church donation.
My question is: How dare the sisters call themselves good Christian if they refuse to take care of their own mother?! (the mother works her entire life to put them to medical school)

I had to leave my full time job to go to school. Grades are really important because it is a pre-certification program for grad school. How do people do it? I'm new to the student loan and financial aid process. I know that some programs say that the students can't work--like med or law school. How can I just focus on my studies and have my expenses taken care of? The cost of gas, cc bills, food, health insurance are some of my concerns.

I am currently based in USA and am thinking of accepting a job offer in Mumbai.

Assuming that I rent a flat/apartment in Mumbai for INR 50,000/month or INR 6,00,000 a year, could I claim this rent expense to reduce my taxable income.

I also heard that you may or may not be able to do this based in whether your company provides HRA- what is that clause?

Resolved Question: Considering Filing for Bankruptcy in Virginia?

I have recently lost my job after being in the telecommunications industry for ten years. I have had no luck finding a new 9-5 job with a regular salary. I have been forced to take a job full time at a restaurant.

I have over $29,000 in credit card debt most with APR's in the high 20's. I have done my best over the last 6 months to keep up with my minimum payments but am finding it impossible recently to balance my debt along with my living expenses. By living expense, I do mean the bare minimums. Rent,utilities, gas, food etc.. I have not wasted funds on entertainment or purchases other than does required for work.

I had an hour long conversation today with a debt consolidation company. It is has been in business since 1965 and is non-profit. I actually used their services in the past to consolidate debt that I managed to pay off about 8 years ago. They analyzed all of my assets, income, debt and overall financial situation. They determined that I was running at a 65% deficit between what I am brining in and what I owe. They recommended that, although it may sound harsh, my best option was to file for bankruptcy. They determined that I would not be able to keep up with any type of repayment schedule that they would negotiate with the banks and that a fresh start may be my best option.

I have avoided the thought of filing for bankruptcy in the past for several reasons. But now that my income is at an all time low and my job prospects do not seem to be sorting themselves out in the near future, I do not now what other options I have available to me. Needless to say, the stress of the whole situation has been making life extremely unpleasant.

I am single, have no kids, and will not be purchasing a house in the near future. The only asset I own, is an 8 year old car.

I have five questions:

1) Other than having a bankruptcy ruling on my file for the next ten years and not being able to secure credit, what are the other disadvantages of filing for bankruptcy?

2) I do not have disposable income. I am making enough to pay for essentials. Would my chances of having the entire debt excused be good? Or would I still be responsible for paying a percentage?

3) I know from my corporate experience that my credit file would be reviewed during the job applications process. I am considering a career with the Federal Government. How would a bankruptcy ruling be looked upon by the government during the job application process?

4) How much with a reputable bankruptcy lawyer cost me?

5) I have also read that another option is to do nothing and ignore my creditors. The following excerpt below is from http://bankruptcy.findlaw.com/ . Is this plausible?

Resolved Question: Who should pay in law's medical expenses? My fiance?

I am engaged to be married to a wonderful man. His mother recently got a stroke and the right side of her body cannot move whatsoever. She has wonderful insurance coverage, but there is still a huge amount of medical cost needs to be taken care of immediately. My fiance is in the process of hiring a full time nanny which is not fully covered by insurance. Fiance has 3 siblings, 2 older sisters plus an older brother.
The medical cost plus nanny will cost them at least $1300 - $1800 / MONTH. The two sisters will be paying $200 - $300 / month at best because they are all married with kids. brother refuses to pay because he has 3 kids with a wife doesn't work. I as a fiance already help out $300 / month, and the rest of the cost need to be paid by my fiance.

We're a family of 3 near CHICAGO: husband, myself, and a toddler who eats!

No big pets and we rarely if ever eat out. Husband bags his own lunch daily. So mostly our food expense is grocery bills.

This month ( with 4 days left ) I've spent $517 so far. I may need some other items before the month's up. But for the last week I made a conscious effort to buy less processed food and that reduced our last bill.

Given I hear 1 person alone spends $250/month on food, is $540 average for 2 adults + toddler who eats regular food now?

Please let me know where you are as that makes a difference: some people have their own chickens or fruit trees etc. I have zero foods I grow myself, plus no time. And I want to know how prices vary across the country...

Voting Question: Should I quit my job because it requires too much driving?

I have to drive alot for my job (around 500 miles/mth. which doesn't count my trip to and from work). My car gets really good gas mileage, but since we only get a flat monthly stipend for all expenses (and it's pretty low...covers about 3 tanks/month), it feels like I should probably have a breaking point...at what point should I quit? The job is okay, but at times really stressful. I'm actually in the process of pursuing another career, but am only going to school PT because of the job. Does anyone have any advice as to when I should vehemently start pursuing other employment? How much of a pay cut should I be willing to take, factoring in all my costs associated with this job (I have to pay for my own cell phone, which I use ALOT, and many home office supplies). Alternatively, should I just start working PT to finish up with school faster?

There are a few benefits to this job....I can do ALOT of work from home, and have alot of say-so in when I work....
They increased the stipend last month by $10, but it probably won't go up much more than that.

When you turn them in to the front desk your personal information is
there for any employee to access by simply scanning the card in the
hotel scanner. An employee can take a hand full of cards home and
using a scanning device, access the information onto a laptop computer
and go shopping at your expense.

Simply put, hotels do not erase the information on these cards until an employee reissues the card to the next hotel guest. At that time, the new guest's information is electronically "overwritten" on the card and the previous guest's information is erased in the overwriting process
But until the card is rewritten for the next guest, it usually is kept
in a drawer at the front desk with YOUR INFORMATION ON IT!

The bottom line is: Keep the cards, take them home with you, or
destroy them. NEVER leave them behind in the room or room wastebasket,
and NEVER turn them into the front desk when you check out of a room.
They will not charge you for the card (it's illegal) and you'll be

I am in the process of buying a business. My parents are going to help out with about 10% down and will be 10% owner. We have it figured out where they will get about 5% of the gross income. They cosigned for the loan at the bank. Now we are trying to figure out the best way for me to pay them back. I have an S-corp. I would be contracted with a huge company and there have not been losses financially. My parents would be 10% owner of the business and make 5% of the net. We're notified about this by the phone, as apparently our invitation got lost in the mail.So we're in a process of booking our flight. The reception takes place at the house of the groom (our friend) 40 km north of Milan, on Lake Como . When asked for help to find out a budget accomodation near by, we're provided with the link to the Castle where the bride (whom we've only met once) have block-booked several rooms. I am not sure if they're getting a special rate, but the list price for a standard double at this place is 300 usd/night. Since we are kind of working with a tight budget here, and not ready to splash out on a 3-4 day holiday of a lifetime, we'd rather stay in a b&b or budget hotel rather than a castle, but..no choice. Resolved Question: Tooth extraction complications...who pays?

I had my wisdom teeth (all 4) removed last week, in the process the oral surgeon broke one of my adjacent molars. I understand that this is a possible complication of tooth extractions, however, my dental insurance will only pay 80% leaving about 200 dollars out of pocket expense to put a cap on the broken molar. I had to save money to pay the 300 to get my wisdom teeth out...I have no idea where I am going to come up with 200 to get my molar fixed.
Should the oral surgeon be responsible for the cost of getting my tooth capped?
